These Terms of Service ("Terms") govern your use of the Bzzip platform operated by Bzzip ("we", "our", "us"). By creating an account or using our service, you agree to these Terms.
1. Service Description
Bzzip is a unified messaging platform that connects WhatsApp Business, Instagram, Facebook Messenger, and TikTok into a single inbox for agency teams. The service includes conversation management, team routing, SLA tracking, broadcast messaging, quick replies, and analytics.
2. Account Registration
- You must be at least 18 years old to create an account
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- Each account is associated with one primary agency
- You must notify us immediately of any unauthorized use of your account
3. Plans & Billing
- Free Trial — New agencies receive a 14-day free trial with full access to platform features
- Paid Plans — We offer Starter, Growth, and Agency plans with monthly and yearly billing options
- Payment — Payments are processed through Stripe or MercadoPago, depending on your region
- Auto-Renewal — Subscriptions automatically renew at the end of each billing period unless cancelled
- Cancellation — You may cancel your subscription at any time. Access continues until the end of the current billing period
- Refunds — We do not provide refunds for partial billing periods
4. Acceptable Use
When using Bzzip, you agree NOT to:
- Send spam, bulk unsolicited messages, or promotional content that violates platform policies
- Transmit illegal, harmful, threatening, or objectionable content
- Violate Meta’s Platform Terms of Service or any connected platform’s terms
- Attempt to reverse engineer, decompile, or disassemble any part of the platform
- Exceed or abuse API rate limits or attempt to circumvent usage restrictions
- Use the platform for any activity that violates applicable laws or regulations
- Share your account credentials or allow unauthorized access to your account
5. Data Ownership
- Your Data — You retain ownership of all message data, contact information, and content created through your use of the platform
- License — You grant Bzzip a limited license to process, store, and transmit your data solely for the purpose of providing the service
- Consent — You are responsible for obtaining any necessary consent from your end-users and contacts for the collection and processing of their data through the platform
6. Intellectual Property
Bzzip and its licensors own all rights to the platform, including its code, design, branding, documentation, and all related intellectual property. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
7. Service Availability
- We provide the service on a best-effort basis and aim for high availability
- The platform depends on third-party APIs (Meta, WhatsApp, etc.) that may experience downtime outside our control
- We will provide reasonable advance notice for scheduled maintenance when possible
- We are not liable for interruptions caused by third-party service outages
8. Limitation of Liability
To the maximum extent permitted by law:
- Bzzip is provided "as is" and "as available" without warranties of any kind
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
- We are not responsible for any loss resulting from third-party API downtime or changes to third-party platform policies
9. Termination
- Either party may terminate the agreement at any time with written notice
- We may suspend or terminate your account for violation of these Terms
- Upon termination, you may request an export of your data within 30 days
- After the 30-day export period, we will delete your data in accordance with our Privacy Policy
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
11. Dispute Resolution
Any dispute arising from these Terms will first be addressed through good faith negotiation between the parties. If the dispute cannot be resolved within 30 days, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
12. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days’ notice via email or a prominent notice on the platform. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
